Terms of Service
These Terms of Service (“Terms”) govern your use of SparX websites, apps, and related services (the “Service”). By creating an account or using SparX, you agree to these Terms.
1. The Service
SparX lets you chat with AI companions (including featured characters such as Elena) and create or customize companions. Responses are generated by artificial intelligence and may be inaccurate, incomplete, or inappropriate. SparX is for entertainment and personal use; it is not professional, medical, legal, or crisis advice.
2. Eligibility
You must be at least 18 years old to use SparX. By using the Service you represent that you meet this requirement.
3. Accounts
You are responsible for your account credentials and for activity under your account. Provide accurate information and keep your password confidential. We may suspend or terminate accounts that violate these Terms or pose a security risk.
4. Acceptable use
- Do not use SparX for illegal activity, exploitation, harassment, or to harm others.
- Do not attempt to reverse engineer, overload, scrape, or disrupt the Service.
- Do not upload malware or content you do not have rights to use.
- Do not use SparX to generate or distribute child sexual abuse material or to sexualize minors (fictional or real).
- Respect rate limits and plan quotas.
5. Subscriptions & billing
Some features require a paid plan (shown as Free or Pro in the product). Prices, trial length, and billing period are displayed at checkout. Fees may be billed through Stripe on the web or through the applicable app store on mobile. Taxes may apply. Refunds follow the payment provider’s or store’s policies unless required by law. We may change prices with reasonable notice for renewals.
6. Content & AI output
You retain rights to content you submit, subject to the license below. You grant SparX a worldwide, non-exclusive license to host, process, and display your content as needed to operate the Service (including sending prompts to AI providers). AI outputs are provided “as is.” You are responsible for how you use them.
7. Intellectual property
SparX branding, software, and design are owned by SparX or its licensors. These Terms do not transfer ownership of our IP to you. Featured character names and companion assets may be protected; do not misuse SparX trademarks.
8. Privacy
Our Privacy Policy describes how we collect and use personal information. By using SparX you also agree to that policy.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation or that AI outputs will meet your expectations.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPARX AND ITS PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID TO SPARX FOR THE SERVICE IN THE 3 MONTHS BEFORE THE CLAIM OR (B) USD $50.
11. Termination
You may stop using SparX at any time. We may suspend or end access if you breach these Terms or if we discontinue the Service. Provisions that by nature should survive (including IP, disclaimers, and liability limits) will survive termination.
12. Changes
We may update these Terms by posting a new version at this URL. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service.
